All services shall be carried out using reasonable skill and care and, where applicable, in accordance with relevant legislation, recognised industry practice and applicable British Standards in force at the time the work is undertaken.
Formation of the Contract
A legally binding contract between you and Edmond Hodaj Ltd shall be formed when we confirm acceptance of your instruction in writing, when you accept our quotation, when we accept a purchase order, when an online booking is confirmed, when payment is accepted, or when work commences at your request, whichever occurs first. These Terms of Service shall apply to the exclusion of any other terms unless expressly agreed in writing by Edmond Hodaj Ltd. Any terms contained within a customer's purchase order or other documentation shall not apply unless specifically accepted in writing by Edmond Hodaj Ltd. No amendment or variation to these Terms shall be binding unless confirmed in writing by an authorised representative of Edmond Hodaj Ltd.
Quotations, Estimates and Tenders
All quotations, estimates and tenders are prepared using the information available at the time they are issued and are based upon the scope of work requested by the customer. Unless otherwise stated, quotations remain valid for thirty days from the date of issue and may be withdrawn or amended before acceptance. Prices are exclusive of Value Added Tax unless expressly stated otherwise. Quotations are subject to site conditions, access, the availability of materials, manufacturer pricing and the accuracy of the information supplied by the customer. Where additional work becomes necessary due to hidden defects, inaccessible areas, defective existing installations, changes in specification, customer instructions, third-party works or circumstances beyond our reasonable control, a revised quotation or variation may be issued before the additional work is carried out. Where immediate action is required to make an installation safe or prevent damage to persons or property, Edmond Hodaj Ltd reserves the right to undertake such work without prior written approval where it is reasonable to do so, and the customer shall remain responsible for the reasonable costs of those works.
Part 3 - Booking and Payment Terms
Introduction
These Booking and Payment Terms govern all appointments, quotations, online bookings, online payments, deposits, invoices and payment arrangements made with Edmond Hodaj Ltd under the NORTHWESTLONDON brand. They apply to all domestic, commercial, industrial, public sector and property management customers and should be read together with our Website Terms & Conditions, Terms of Service, Cancellation & Refund Policy, Warranty Policy, Privacy Policy and any other applicable policies published by Edmond Hodaj Ltd. By requesting a quotation, making a booking, paying a deposit, accepting a quotation, issuing a purchase order, making an online payment or instructing us to commence work, you confirm that you have read, understood and agree to be bound by these Booking and Payment Terms.
Booking Our Services
Bookings may be made through our website, by telephone, email or any other communication method approved by Edmond Hodaj Ltd. All bookings submitted through our website constitute a request for an appointment and do not become binding until confirmed by Edmond Hodaj Ltd. We reserve the right to accept, decline, amend or reschedule any booking where necessary due to engineer availability, operational requirements, health and safety considerations, weather conditions, material availability, emergencies or any other reasonable circumstance beyond our control. Where a booking cannot be accommodated, we will make reasonable efforts to offer the next available appointment.
Appointment Confirmations
Once your booking has been accepted, we will issue confirmation by email, text message or other written communication. Appointment dates and arrival times are estimates only and should not be treated as guaranteed attendance times. Whilst every reasonable effort will be made to attend within the agreed time period, delays may occur due to emergency call-outs, previous works exceeding their anticipated duration, traffic conditions, adverse weather, supplier delays or circumstances beyond our reasonable control. Such delays shall not constitute a breach of contract.
Quotations Prior to Booking
Where a quotation is required before work can proceed, no booking shall be confirmed until the quotation has been accepted by the customer. Acceptance may be provided by email, written confirmation, electronic acceptance through our website, purchase order or any other method approved by Edmond Hodaj Ltd. Once accepted, the quotation together with these Booking and Payment Terms shall form part of the contract between the parties.
Deposits
Edmond Hodaj Ltd reserves the right to request a deposit before confirming any booking or ordering materials. Deposits may be required for larger projects, bespoke installations, specialist equipment, made-to-order products, projects involving significant material costs or appointments requiring dedicated engineering resources. Unless otherwise agreed, any deposit paid shall be deducted from the final invoice. Where materials have been specifically purchased for a customer's project, deposits may be retained to cover those costs where permitted by law. Payment of a deposit confirms the customer's intention to proceed with the agreed works but does not affect any statutory rights available under applicable legislation.
Online Payments
Where online payment facilities are available, payments shall be processed through secure third-party payment providers. Edmond Hodaj Ltd does not store complete payment card details and all online transactions are subject to the security procedures and operating terms of the relevant payment provider. Customers are responsible for ensuring that payment details entered during the transaction are accurate and authorised.
Payment Terms
Unless otherwise agreed in writing, payment shall become due immediately upon completion of the works for domestic customers. Commercial customers, managing agents, housing associations, local authorities and business clients shall make payment in accordance with the payment period specified within the quotation, purchase order or invoice. Edmond Hodaj Ltd reserves the right to require staged payments, interim valuations or milestone payments for larger projects, long-term contracts or contracts involving substantial material expenditure.
Invoices
Invoices will normally be issued electronically upon completion of the agreed works unless alternative arrangements have been agreed in writing. Each invoice will identify the services provided, materials supplied, applicable taxes and the total amount payable. Customers are responsible for reviewing invoices promptly and notifying Edmond Hodaj Ltd without unreasonable delay should they believe an error has occurred.
Variation of Works
Where the customer requests changes to the agreed scope of works after a booking has been confirmed, Edmond Hodaj Ltd may issue a revised quotation or variation before the additional work is undertaken. Additional works may affect previously agreed appointment durations, completion dates and pricing. Where urgent remedial work is necessary to make an installation safe or prevent damage to persons or property, Edmond Hodaj Ltd may proceed without prior written approval where it is reasonable to do so, and the customer agrees to pay the reasonable costs associated with those works.
Late Payment
Failure to make payment by the due date may result in interest being charged on outstanding balances together with any reasonable recovery costs permitted by law. Commercial customers may also be liable for statutory interest and compensation in accordance with the Late Payment of Commercial Debts (Interest) Act 1998. Edmond Hodaj Ltd reserves the right to suspend ongoing works, postpone future appointments, withhold certification, reports, warranties, manuals, commissioning documentation or any other project documentation until all outstanding amounts have been paid in full.
Ownership of Goods and Materials
All goods, materials, equipment, components and products supplied by Edmond Hodaj Ltd shall remain the property of Edmond Hodaj Ltd until payment has been received in full. The risk in those goods shall pass to the customer upon delivery or installation, however legal ownership shall remain with Edmond Hodaj Ltd until all sums due under the contract have been paid. Edmond Hodaj Ltd reserves all rights available at law to recover unpaid goods where payment has not been received.
Failed Appointments and Access
Customers shall ensure that suitable access is available at the agreed appointment time and that the working area is safe and ready for the agreed works. Where access cannot be gained, the property is unavailable, the works cannot proceed due to circumstances within the customer's control or the appointment is cancelled upon arrival, Edmond Hodaj Ltd reserves the right to charge for the engineer's time, travel, administration, parking charges, congestion or clean air charges where applicable, and any other reasonable costs incurred as a result of the aborted visit.
Payment Disputes
Should a customer dispute any part of an invoice, Edmond Hodaj Ltd must be notified in writing as soon as reasonably practicable, setting out the reasons for the dispute together with any supporting evidence. The undisputed portion of the invoice shall remain payable in accordance with these Terms while the disputed element is investigated. Both parties shall use reasonable endeavours to resolve any dispute promptly and in good faith. Where resolution cannot be reached, either party may pursue any remedies available under the laws of England and Wales.
Part 4 - Cancellation & Refund Policy
Introduction
This Cancellation & Refund Policy applies to all quotations, bookings, appointments, online bookings, deposits, online payments, goods and services supplied by Edmond Hodaj Ltd under the NORTHWESTLONDON brand. It should be read together with our Website Terms & Conditions, Terms of Service, Booking and Payment Terms, Warranty Policy and any other applicable policies published by Edmond Hodaj Ltd. By making a booking, accepting a quotation, paying a deposit or instructing us to commence work, you agree to the terms of this Cancellation & Refund Policy.
Customer Cancellations
Customers may cancel or reschedule a booking by contacting Edmond Hodaj Ltd using the contact details provided on our website. We request that cancellation or rescheduling requests are made as soon as reasonably practicable to allow appointments to be reallocated. Cancellation requests shall not be considered effective until acknowledged by Edmond Hodaj Ltd. Where work has not commenced and no materials or services have been specifically committed to the project, cancellations may be accepted without charge, subject to the provisions of this Policy.
Cancellation After Acceptance of a Quotation
Where a quotation has been accepted and Edmond Hodaj Ltd has commenced planning, ordering materials, allocating engineers or undertaking preparatory works, the customer may remain liable for any reasonable costs incurred up to the date of cancellation. Such costs may include administration, design work, surveys, special-order materials, non-returnable products, supplier cancellation charges, labour already undertaken and any other expenditure reasonably incurred in connection with the contract.
Deposits
Where a deposit has been paid, the deposit shall normally be credited against the final invoice. If the customer cancels before work commences, any refundable amount shall be assessed after deducting any reasonable costs already incurred by Edmond Hodaj Ltd, including administration, surveys, material purchases, supplier charges and other project-related costs. Deposits paid for bespoke, made-to-order or non-returnable products may not be refundable where those items cannot reasonably be cancelled or returned.
Rescheduling Appointments
Customers may request that an appointment is rescheduled by contacting Edmond Hodaj Ltd as early as possible. Whilst every reasonable effort will be made to accommodate the requested date, all alternative appointments remain subject to engineer availability and operational requirements. Repeated requests to reschedule may result in additional charges where labour, specialist equipment or third-party contractors have already been committed to the booking.
Cancellation by Edmond Hodaj Ltd
Edmond Hodaj Ltd reserves the right to postpone or cancel appointments where necessary due to illness, engineer unavailability, severe weather, supplier delays, material shortages, health and safety concerns, emergency call-outs, force majeure events or circumstances beyond our reasonable control. Where this occurs, we will use reasonable endeavours to notify the customer promptly and arrange an alternative appointment at the earliest reasonable opportunity. Unless required by law, Edmond Hodaj Ltd shall not be liable for any indirect or consequential losses arising from such postponement or cancellation.
Failure to Provide Access
Customers are responsible for ensuring that safe and unrestricted access is available at the agreed appointment time. Where engineers are unable to gain access, are prevented from carrying out the agreed works, or are required to leave due to circumstances within the customer's control, Edmond Hodaj Ltd reserves the right to charge for the aborted visit, engineer's time, travel expenses, parking charges, congestion or clean air charges where applicable, and any other reasonable costs incurred. A further appointment may be treated as a new booking and additional charges may apply.
Refunds
Where a refund is due, Edmond Hodaj Ltd will process the refund using the original payment method wherever reasonably practicable. Refunds will normally be processed after any outstanding costs, supplier charges or non-refundable expenses have been deducted in accordance with this Policy. Refunds shall not normally be provided for services already completed, labour already undertaken, certificates already issued or materials that have been supplied, installed or specifically ordered for the customer's project, except where required by law.
Faulty Goods and Defective Services
Nothing within this Policy limits or excludes the customer's statutory rights under applicable consumer protection legislation. Where goods supplied by Edmond Hodaj Ltd are defective, or where services have not been carried out using reasonable skill and care, Edmond Hodaj Ltd will investigate the matter and, where appropriate, repair, replace, rectify or refund the affected goods or services in accordance with our Warranty Policy and applicable legislation.
Third-Party Products and Services
Where goods, specialist equipment or services are supplied by third-party manufacturers, suppliers or specialist contractors, refunds may be subject to the terms and conditions of the relevant supplier or manufacturer. Edmond Hodaj Ltd will use reasonable endeavours to assist customers with warranty or refund claims where appropriate, but reserves the right to apply any supplier restocking charges, cancellation fees or other reasonable costs incurred as a result of the customer's cancellation.
Exceptional Circumstances
Edmond Hodaj Ltd may, at its absolute discretion, consider requests for refunds, credits or rescheduling outside the terms of this Policy where exceptional circumstances exist. Any decision made under this provision shall be entirely at the discretion of Edmond Hodaj Ltd and shall not create a precedent or obligation to make similar decisions in future cases.
Changes to this Policy
Edmond Hodaj Ltd reserves the right to amend this Cancellation & Refund Policy from time to time to reflect changes in legislation, business operations or company procedures. The latest version will be published on our website and shall apply to all bookings and contracts entered into after the date of publication unless otherwise required by law.
Part 5 - Workmanship Warranty Policy
Introduction
This Workmanship Warranty Policy applies to all services provided by Edmond Hodaj Ltd under the NORTHWESTLONDON brand. It explains the warranty provided on our workmanship, the circumstances in which warranty claims may be made, the exclusions that apply and the responsibilities of both Edmond Hodaj Ltd and the customer. This Policy should be read together with our Website Terms & Conditions, Terms of Service, Booking and Payment Terms, Cancellation & Refund Policy and any other applicable policies published by Edmond Hodaj Ltd.
Our Workmanship Warranty
Edmond Hodaj Ltd warrants that all workmanship carried out by our employees and authorised subcontractors will be completed using reasonable skill, care and diligence and, where applicable, in accordance with the relevant legislation, recognised industry practice and applicable British Standards in force at the time the work is undertaken. Subject to the terms of this Policy, we will rectify defects arising directly from faulty workmanship reported during the applicable warranty period without additional labour charges.
Warranty Period
Unless otherwise stated in writing, our workmanship warranty shall apply for a period of twelve months from the date the relevant works are completed. Different warranty periods may apply to specific projects, commercial maintenance contracts, specialist installations or manufacturer-approved systems where confirmed in writing within the quotation, contract or completion documentation.
Manufacturer's Warranties
Products, equipment and materials supplied by Edmond Hodaj Ltd are covered by the manufacturer's warranty where one is provided. Manufacturer warranties remain the responsibility of the relevant manufacturer and are subject to their own terms and conditions. Edmond Hodaj Ltd will use reasonable endeavours to assist customers in making warranty claims where appropriate but cannot extend, amend or replace the manufacturer's warranty obligations.
Warranty Claims
Any defect believed to be covered by this Policy must be reported to Edmond Hodaj Ltd as soon as reasonably practicable after it becomes apparent. Customers should provide sufficient information to allow the issue to be assessed, including photographs where available, together with details of the original works and any changes made to the installation since completion. Edmond Hodaj Ltd reserves the right to inspect the installation before accepting liability under this Policy and to determine the appropriate method of rectification.
Exclusions
This Workmanship Warranty does not apply to defects arising from fair wear and tear, accidental damage, misuse, neglect, vandalism, water ingress, flooding, fire, structural movement, rodent or pest damage, corrosion, environmental conditions, power surges, utility supply faults, inadequate maintenance, alterations carried out by others, unauthorised repairs, customer-supplied materials, manufacturer defects or any circumstances beyond the reasonable control of Edmond Hodaj Ltd. The warranty shall also be void where the installation has been modified, dismantled or interfered with by any person other than Edmond Hodaj Ltd unless prior written approval has been obtained.
Customer Responsibilities
The customer is responsible for ensuring that all installations are used in accordance with the manufacturer's instructions and any guidance provided by Edmond Hodaj Ltd. Appropriate maintenance, testing and servicing should be carried out where required by law, British Standards or manufacturer recommendations. Failure to maintain equipment correctly may invalidate both the workmanship warranty and any applicable manufacturer's warranty.
Subcontracted Works
From time to time Edmond Hodaj Ltd may appoint suitably qualified subcontractors to carry out specialist works. Where such works are carried out under a contract with Edmond Hodaj Ltd, the workmanship shall be covered by this Policy to the same extent as work undertaken directly by our employees. Where specialist equipment carries separate manufacturer-approved installation requirements or insurance-backed guarantees, the relevant third-party warranty shall apply in addition to this Policy.
Remedial Works
Where Edmond Hodaj Ltd accepts that a defect is covered by this Policy, we will determine the most appropriate method of remedy, which may include repair, replacement, adjustment or reinstallation of the affected work. The selection of the appropriate remedy shall remain at the discretion of Edmond Hodaj Ltd. This Policy does not entitle the customer to a refund where repair or replacement represents an appropriate solution.
Access for Warranty Repairs
Customers must provide reasonable access to the property and the affected installation to enable inspection and any necessary remedial works. Where access cannot be provided or appointments are missed due to circumstances within the customer's control, additional charges may apply for subsequent visits.
Limitation of Warranty
This Workmanship Warranty applies solely to the workmanship carried out by Edmond Hodaj Ltd and shall not extend the manufacturer's warranty, create any additional guarantee regarding the expected lifespan of products or systems, or cover consequential losses, business interruption, loss of earnings, alternative accommodation costs or any indirect losses except where liability cannot legally be excluded under the laws of England and Wales.
Changes to this Policy
Edmond Hodaj Ltd reserves the right to amend this Workmanship Warranty Policy from time to time to reflect changes in legislation, industry standards, business practices or operational requirements. The version published on our website at the date the contract is entered into shall apply to the relevant works unless otherwise agreed in writing.
Part 6 - Quotation & Tender Terms
Introduction
These Electrical Installation Terms apply to all electrical installation, alteration, inspection, testing, maintenance and remedial works carried out by Edmond Hodaj Ltd under the NORTHWESTLONDON brand. They should be read together with our Website Terms & Conditions, Terms of Service, Booking and Payment Terms, Cancellation & Refund Policy, Workmanship Warranty Policy and any other applicable policies published by Edmond Hodaj Ltd. By instructing us to undertake electrical works, you agree to these Electrical Installation Terms.
Scope of Works
Electrical works shall be carried out strictly in accordance with the accepted quotation, specification, drawings or written instructions provided by the customer. Any variation to the agreed scope of works requested after acceptance of the quotation may result in additional costs, revised completion dates or amended installation requirements. Edmond Hodaj Ltd reserves the right to refuse instructions that conflict with statutory requirements, recognised industry practice or electrical safety standards.
Compliance with Regulations
All electrical installations shall be carried out, where applicable, in accordance with the current edition of BS 7671 Requirements for Electrical Installations (IET Wiring Regulations), relevant Building Regulations, Electricity at Work Regulations 1989 and any other applicable legislation and recognised industry standards in force at the time the works are undertaken. Certification will be issued where required by the nature of the works and applicable regulations.
Existing Installations
Electrical installations may contain hidden defects that cannot reasonably be identified before work commences. Edmond Hodaj Ltd shall not be responsible for pre-existing defects, concealed wiring, inaccessible accessories, undocumented alterations or non-compliant installations that become apparent only after work has started. Where additional defects are discovered, we will inform the customer and provide recommendations together with a quotation for any further works where appropriate.
Isolation of Electrical Supplies
The customer acknowledges that electrical supplies may need to be isolated during the course of the works to allow installations to be carried out safely. Every reasonable effort will be made to minimise disruption; however, Edmond Hodaj Ltd accepts no responsibility for losses arising from necessary interruptions to the electrical supply. Customers remain responsible for ensuring that computers, servers, alarms, refrigeration equipment, medical devices and any other sensitive equipment are safely shut down or otherwise protected before electrical supplies are isolated.
Access and Working Conditions
The customer shall provide safe, unrestricted and reasonable access to all areas where work is to be carried out. The working area must be free from unnecessary obstructions and reasonably safe for our employees and subcontractors. Where access is restricted, unsafe or prevented by third parties, Edmond Hodaj Ltd reserves the right to postpone the works and recover any reasonable costs arising from the delay.
Customer-Supplied Equipment
Where the customer requests the installation of equipment or materials supplied by others, Edmond Hodaj Ltd accepts responsibility only for the workmanship associated with the installation. We do not provide any warranty regarding the suitability, quality, compatibility, performance or safety of customer-supplied products and reserve the right to refuse installation where we reasonably believe the equipment is defective, unsafe or unsuitable for the intended application.
Testing and Certification
Where applicable, electrical installations shall be inspected and tested upon completion in accordance with the relevant requirements of BS 7671. Certificates, schedules of test results and associated documentation will be issued where required, subject to payment of all outstanding sums due under the contract. Certification relates only to the work undertaken by Edmond Hodaj Ltd unless expressly stated otherwise.
Completion of Works
Practical completion shall be deemed to occur when the agreed electrical works have been completed to a stage where they are capable of being used for their intended purpose, notwithstanding the existence of minor defects or outstanding items that do not materially affect the safe operation of the installation. Any agreed snagging items shall be completed within a reasonable period following practical completion.
Customer Alterations
Following completion of the works, the customer must not alter, extend, interfere with or permit others to modify the installation without ensuring that the work complies with applicable legislation and recognised industry standards. Edmond Hodaj Ltd shall not be responsible for defects, failures or safety issues arising from alterations or additions carried out by third parties after completion of our works.
Limitation of Responsibility
Edmond Hodaj Ltd shall not be liable for defects, failures or damage arising from deterioration of existing installations, failure of customer-supplied equipment, defects concealed within the building structure, interruptions to utility supplies, misuse of the installation, lack of maintenance, unauthorised alterations or circumstances beyond our reasonable control. Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded under the laws of England and Wales.
Changes to these Terms
Edmond Hodaj Ltd reserves the right to amend these Electrical Installation Terms from time to time to reflect changes in legislation, British Standards, industry guidance or business practices. The version in force on the date the contract is entered into shall apply unless otherwise agreed in writing.
Part 7 - Commercial (Business-to-Business) Terms
Introduction
These Commercial (Business-to-Business) Terms apply to all goods and services supplied by Edmond Hodaj Ltd under the NORTHWESTLONDON brand to companies, partnerships, limited liability partnerships, sole traders, landlords, managing agents, housing associations, local authorities, public bodies and any other organisation acting in the course of business. These Terms should be read together with our Website Terms & Conditions, Terms of Service, Booking and Payment Terms, Cancellation & Refund Policy, Workmanship Warranty Policy and any other applicable policies published by Edmond Hodaj Ltd. By requesting a quotation, issuing a purchase order, instructing us to commence work or otherwise engaging our services, you agree to be bound by these Commercial Terms.
Business Customers
These Terms apply only where the customer is acting wholly or mainly for the purposes of their business, trade, profession or occupation. Consumer protection legislation applicable to private individuals may not apply to contracts entered into on a business-to-business basis.
Formation of the Contract
A legally binding contract shall be formed when Edmond Hodaj Ltd accepts a purchase order, quotation, written instruction or other request for services, or when work commences at the customer's request, whichever occurs first. Any terms contained within a customer's purchase order, framework agreement or other documentation shall not apply unless expressly accepted in writing by Edmond Hodaj Ltd.
Quotations and Purchase Orders
Quotations are based upon the information available at the time of preparation and remain valid for the period stated within the quotation unless withdrawn earlier. Purchase orders should accurately describe the agreed works, property address, billing details and any project-specific requirements. Any discrepancies between the quotation and purchase order should be resolved before work commences.
Scope of Works
Services shall be carried out in accordance with the accepted quotation, specification, drawings, purchase order or written instructions. Any variation to the agreed scope of works may result in additional charges, revised completion dates or amended specifications. Edmond Hodaj Ltd shall not be obliged to carry out additional works unless instructed by the customer or where immediate action is reasonably necessary to make an installation safe or prevent damage to persons or property.
Access and Site Conditions
The customer shall provide safe, unrestricted and timely access to the site together with any permits, permissions, keys, access codes or instructions required for the works. The customer shall ensure that the working environment complies with applicable health and safety legislation and that any known hazards, asbestos, structural risks or restricted areas are disclosed before work commences. Delays arising from restricted access, unsafe conditions or third-party contractors may result in additional charges.
Programme and Completion
Any programme, attendance date or completion date provided by Edmond Hodaj Ltd is an estimate only unless expressly agreed otherwise in writing. Completion dates may be affected by weather conditions, material shortages, client variations, utility providers, statutory authorities, third-party contractors or circumstances beyond our reasonable control. Reasonable extensions of time shall apply where delays occur for reasons outside our control.
Subcontractors
Edmond Hodaj Ltd reserves the right to appoint suitably qualified employees, subcontractors or specialist contractors to carry out all or part of the works where considered appropriate. All subcontractors shall be required to maintain appropriate insurance and carry out works to recognised industry standards. Edmond Hodaj Ltd shall remain responsible for the overall management of the contract unless otherwise agreed in writing.
Payment Terms
Invoices shall be paid within the payment period stated on the quotation, purchase order or invoice. Where no payment period has been agreed, payment shall become due within fourteen days from the date of the invoice. Edmond Hodaj Ltd reserves the right to request deposits, interim payments or stage payments depending upon the value and duration of the contract.
Late Payment
Where payment is not received by the due date, Edmond Hodaj Ltd reserves the right to charge statutory interest, fixed compensation and reasonable debt recovery costs in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 and any subsequent amendments. We may also suspend ongoing works, refuse future bookings and withhold certification, reports, warranties or completion documentation until all outstanding amounts have been paid in full.
Retention of Title
Ownership of all goods, materials, equipment and products supplied by Edmond Hodaj Ltd shall remain with Edmond Hodaj Ltd until payment has been received in full. Risk in the goods shall pass to the customer upon delivery or installation, however legal title shall remain with Edmond Hodaj Ltd until all monies due under the contract have been paid.
Defects and Warranty
The customer shall notify Edmond Hodaj Ltd of any alleged defects as soon as reasonably practicable after they become apparent. Edmond Hodaj Ltd shall be given a reasonable opportunity to inspect the works and carry out any remedial work covered by the Workmanship Warranty before the customer instructs others to undertake repairs. Unauthorised repairs carried out by third parties may invalidate the warranty to the extent permitted by law.
Limitation of Liability
To the fullest extent permitted by law, Edmond Hodaj Ltd shall not be liable for indirect or consequential loss, loss of profit, loss of revenue, loss of business, loss of contracts, loss of anticipated savings, business interruption or any similar financial loss arising out of or in connection with the contract. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or any other liability that cannot legally be excluded under the laws of England and Wales.
Termination
Either party may terminate the contract where the other commits a material breach of its contractual obligations and fails to remedy that breach within a reasonable period after receiving written notice. Edmond Hodaj Ltd may also terminate or suspend the contract where payment remains outstanding, access is repeatedly denied, the working environment becomes unsafe or the customer becomes insolvent or enters administration, liquidation or any similar insolvency process.
Governing Law
These Commercial (Business-to-Business) Terms shall be governed by and interpreted in accordance with the laws of England and Wales. Any dispute arising from or relating to these Terms or the services provided by Edmond Hodaj Ltd shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Part 8 - Domestic Customer Terms
Introduction
These Domestic Customer Terms apply to all goods and services supplied by Edmond Hodaj Ltd under the NORTHWESTLONDON brand to customers acting wholly or mainly for purposes outside their trade, business, craft or profession. These Terms should be read together with our Website Terms & Conditions, Terms of Service, Booking and Payment Terms, Cancellation & Refund Policy, Workmanship Warranty Policy, Privacy Policy and any other applicable policies published by Edmond Hodaj Ltd. By requesting a quotation, making a booking, accepting a quotation, making payment or instructing us to commence work, you agree to be bound by these Domestic Customer Terms.
Formation of the Contract
A contract between you and Edmond Hodaj Ltd is formed when you accept our quotation, confirm an online booking that has been accepted by us, instruct us to commence work, or when we begin providing the agreed services at your request. These Terms shall apply to the contract unless otherwise agreed in writing.
Our Services
Edmond Hodaj Ltd provides professional electrical, fire protection, emergency lighting, access control, inspection, testing, maintenance and associated engineering services for domestic properties. All work will be carried out using reasonable skill and care and, where applicable, in accordance with relevant legislation, recognised industry practice and applicable British Standards in force at the time the work is undertaken.
Quotations and Pricing
All quotations are based upon the information available at the time they are prepared and remain valid for the period stated within the quotation unless withdrawn or amended earlier. Quotations are based on the agreed scope of works and may be revised where hidden defects, inaccessible areas, changes requested by the customer or unforeseen site conditions affect the original scope. Unless otherwise stated, quotations are inclusive of Value Added Tax where required by law.
Customer Responsibilities
The customer shall provide safe and unrestricted access to the property at the agreed appointment time, ensure that children and pets are kept away from the working area where reasonably practicable, disclose any known hazards that may affect the works and obtain any permissions required before work commences. The customer shall ensure that valuable items, furniture and personal belongings are adequately protected or removed from the working area where necessary.
Appointment Times
Appointment dates and arrival times are estimates only. Edmond Hodaj Ltd will use reasonable endeavours to attend at the agreed time; however, delays may occur due to emergency call-outs, traffic conditions, previous works exceeding their anticipated duration, adverse weather or circumstances beyond our reasonable control. Where delays occur, we will make reasonable efforts to keep the customer informed.
Changes to the Agreed Works
If the customer requests additional work or changes to the agreed specification after work has commenced, Edmond Hodaj Ltd may provide a revised quotation before proceeding. Additional works may affect the agreed price, duration of the works and anticipated completion date.
Payments
Payment shall be made in accordance with the agreed quotation, invoice or Booking and Payment Terms. Edmond Hodaj Ltd reserves the right to request deposits, staged payments or full payment upon completion depending upon the nature and value of the works. Certificates, reports, warranties and other completion documentation may be withheld until all outstanding amounts have been paid in full where permitted by law.
Customer-Supplied Materials
Where the customer requests the installation of materials or equipment supplied by others, Edmond Hodaj Ltd accepts responsibility only for the workmanship associated with the installation. We do not warrant the quality, suitability, compatibility or performance of customer-supplied products and reserve the right to refuse installation where we reasonably believe they are unsafe, defective or unsuitable.
Completion of the Works
The works shall be regarded as complete when the agreed installation, repair or service has been finished to a standard that allows it to be used safely for its intended purpose, notwithstanding the existence of minor defects or cosmetic items that do not materially affect the operation or safety of the installation. Any agreed snagging items will be completed within a reasonable period.
Workmanship Warranty
Work carried out by Edmond Hodaj Ltd is covered by our Workmanship Warranty Policy. Manufacturer warranties remain subject to the relevant manufacturer's own terms and conditions. Warranty claims must be reported as soon as reasonably practicable after a defect becomes apparent, and Edmond Hodaj Ltd shall be given a reasonable opportunity to inspect and, where appropriate, rectify the issue before any third party is instructed.
Limitation of Liability
Nothing within these Terms excludes or limits any rights or remedies available to you under the Consumer Rights Act 2015 or any other applicable legislation. Part 9 - Complaints Procedure
Introduction
Edmond Hodaj Ltd is committed to providing a professional, reliable and high-quality service. We recognise that, despite our best efforts, concerns or complaints may occasionally arise. This Complaints Procedure explains how complaints should be submitted, investigated and resolved. It applies to all services provided under the NORTHWESTLONDON brand and should be read together with our Terms of Service and other applicable policies.
Making a Complaint
If you are dissatisfied with any aspect of our service, we encourage you to contact us as soon as reasonably practicable so that the matter can be investigated promptly. Complaints should be submitted in writing by email or post and should include your name, contact details, property address, invoice or quotation reference where applicable, a clear description of the complaint and any supporting information or photographs that may assist our investigation.
Acknowledgement of Your Complaint
We will acknowledge receipt of your complaint as soon as reasonably practicable and begin an initial review. Where further information is required, we may contact you to obtain additional details before commencing our investigation.
Investigation
Each complaint will be investigated fairly, impartially and objectively by Edmond Hodaj Ltd. We may review relevant documentation, quotations, invoices, certificates, photographs, correspondence, site records and any other information considered necessary. Where appropriate, we may arrange a site visit to inspect the works forming the subject of the complaint.
Our Response
Following completion of our investigation, we will provide our findings in writing. Where we determine that remedial work is required, we will explain the proposed solution and, where appropriate, arrange a mutually convenient appointment to carry out the necessary works. Where we conclude that the complaint is not upheld, we will explain the reasons for our decision.
Access for Inspection and Remedial Works
Where a complaint relates to completed works, the customer must provide Edmond Hodaj Ltd with a reasonable opportunity to inspect the installation and carry out any remedial work considered necessary before instructing another contractor. Failure to provide such opportunity may affect any entitlement to reimbursement or warranty claims to the extent permitted by law.
Complaints Relating to Third Parties
Where a complaint relates to equipment, materials or services supplied by a third-party manufacturer, supplier or specialist contractor, Edmond Hodaj Ltd will use reasonable endeavours to assist in resolving the matter. However, any manufacturer's warranty or third-party guarantee shall remain subject to the relevant provider's own terms and conditions.
Unreasonable or Vexatious Complaints
Edmond Hodaj Ltd reserves the right to limit or discontinue correspondence where a complaint is found to be abusive, repetitive, vexatious or where all reasonable steps have been taken to investigate and resolve the matter. This shall not affect any legal rights available to either party.
Alternative Dispute Resolution
Where a complaint cannot be resolved through our internal complaints procedure, both parties are encouraged to seek resolution through negotiation or another appropriate form of alternative dispute resolution before commencing legal proceedings where appropriate.
Legal Rights
Nothing contained within this Complaints Procedure restricts or limits any statutory rights or legal remedies available to either party under the laws of England and Wales.
Changes to this Complaints Procedure
Edmond Hodaj Ltd reserves the right to amend this Complaints Procedure from time to time to reflect changes in legislation, industry guidance or business practices. The latest version will be published on our website and shall apply from the date of publication unless otherwise stated.
